In a unanimous decision, the US Court of Appeals for the District of Columbia Circuit
has ruled in favor of Luminant and other petitioners, holding that the Environmental
Protection Agency over-controlled Texas and other states in its Cross-State Air Pollution Rule.
The Court held that Texas’s and certain other states’ emissions budgets were
“invalid,” and instructed EPA to promptly reconsider those states’ budgets.
Luminant is pleased that the Court agreed with its arguments.
Since CSAPR went into effect in January 2015, Luminant has complied and will
continue to comply with the requirements of the rule. We look forward to
participating in the EPA’s rulemaking process on remand to develop increased budgets.
Luminant remains proud of and committed to upholding its legacy of meeting or
outperforming all environmental laws, rules and regulations.
I want to personally thank each and every one of you for your continued support on these efforts and especially those of you that have testified and / or written letters in support of our position on these issue.
Please let me know if you have any questions or need additional information on this issue or any of the many others that we all confront in our businesses.
Thanks.
